Terms of Service
This is a template provided for transparency and is pending review by legal counsel. It is not legal advice and may change before launch.
These terms govern your use of ChatKit. By creating an account you agree to them on behalf of yourself or the organisation you represent. We've tried to keep them short and readable.
01The service
ChatKit lets you train an AI agent on your content, embed a chat widget on your website, and handle conversations together with your team in a shared inbox. We may improve and change features over time; we won't remove core functionality from a paid plan during a billing period.
02Your account
- You must provide accurate information and keep your credentials secure.
- You are responsible for activity in your workspace, including your team members.
- You must be at least 16 years old and able to form a binding contract.
03Your content and your visitors
You keep all rights to the content you upload and the conversations on your site. You grant us a limited licence to process it solely to provide the service.
You confirm you have the right to use the content you train your agent on, and that you will inform your website visitors about the chat (for example in your own privacy policy). For visitor data we act as your processor under our DPA — see our Privacy Policy.
04AI-generated answers
AI answers are generated from your content and may occasionally be incomplete or wrong. Strict mode and citations reduce this risk but don't eliminate it. You are responsible for reviewing your agent's configuration and for any commitments it makes to your customers. Don't use ChatKit as the sole basis for medical, legal or financial decisions.
05Acceptable use
- No unlawful, deceptive, harassing or infringing content.
- No attempts to break, overload, or reverse-engineer the service, or to bypass usage limits.
- No sending spam or collecting data from visitors without a lawful basis.
06Plans, billing and cancellation
- Paid plans are billed in advance, monthly or yearly, through Stripe. Prices exclude applicable taxes.
- The 14-day trial requires no card. When it ends you move to the Free plan unless you choose a paid plan.
- Usage is hard-capped by default. Overage packs are billed only if you explicitly enable them. We never upgrade your plan automatically.
- You can cancel anytime from your billing settings; your plan remains active until the end of the period. Unused months of yearly plans are refunded on a prorated basis. If you're not satisfied within 30 days of your first payment, contact [email protected] for a full refund of that payment. Usage never upgrades your plan automatically; overage packs are charged only if you turn them on.
- We will give at least 30 days' notice of any price change to your plan.
07Availability and support
We aim for high availability but the service is provided “as is” without a guaranteed uptime unless agreed in writing. Support is available at [email protected].
08Liability
To the extent permitted by law, neither party is liable for indirect or consequential losses, and our total liability is limited to the fees you paid us in the 12 months before the claim. Nothing limits liability that cannot be limited by law.
09Termination
We may suspend accounts that breach these terms or put the service at risk, with notice where reasonable. On termination you can export your data for 30 days, after which it is deleted.
10Governing law and changes
These terms are governed by the laws of the EU member state in which ChatKit is established, without prejudice to mandatory consumer protections. We'll notify you of material changes at least 30 days in advance. Questions: [email protected].
